When are you justified in the use of deadly force?
1. When forced to use a gun for the purpose of personal protection and stop an attack on you or another, be sure you are truly threatened, and reasonably believe that you or "he or she is in imminent danger of death or great bodily harm and that he or she has exhausted every reasonable means to escape such danger"
2. You are also justified to "prevent the imminent commission of a forcible felony".
What is a Forcible Felony?
Statute 776.08 "Forcible felony" means treason; murder; manslaughter; sexual battery; carjacking; home-invasion robbery; robbery; burglary; arson; kidnapping; aggravated assault; aggravated battery; aggravated stalking; aircraft piracy; unlawful throwing, placing, or discharging of a destructive device or bomb; and any other felony which involves the use of threat of physical force or violence against any individual
Also, deadly force is not warranted for protection of property
If you catch a thief climbing out of your kitchen window with your TV, it is not lawful to shoot him. Remember, it is always best to avoid confrontation and especially if a path to retreat will keep you safe without using a weapon. A retreat route is always first choice. Gun fights are always bad and the last resort.
You may feel like you are protecting your family but whenever gunfire happens, the potential for disaster is always present. Criminals may have guns of their own and many are accustomed to using them with no regard. Many times criminals take the gun away from law abiding citizens or law enforcement officials and use the " good guys" weapon against themselves.
Potential Civil Suites
Then many times, if you win, the gun battle, you spend a fortune just keeping a grieving family from suing for millions. Law abiding citizens are held to a high standard and must use care and good judgment before consideration of using your concealed carry gun.
